Terms of Service

These terms govern access to Lucette, including accounts, generated outputs, credits, subscriptions, cancellations and refunds.

Agreement

By accessing or using Lucette, you agree to these Terms of Service and our Privacy Policy. Lucette is operated by Foto Friend Pty Ltd (ABN 49 135 954 068) of Level 5, 44 Market St, Sydney NSW 2000, Australia. If you use Lucette for an organisation, you confirm that you have authority to accept these terms for that organisation. If you do not agree, do not use the service.

Eligibility and accounts

You must be legally able to enter a contract. You must provide accurate account information, keep credentials secure, and promptly tell us about suspected unauthorised access. You are responsible for activity performed through your account and for ensuring that workspace members are authorised to access shared content.

The service and AI-generated output

Lucette uses automated systems and third-party sources to produce research, reports and other materials. Generated output may be incomplete, inaccurate, outdated or unsuitable for a particular purpose. You must review important information and source references before relying on it. Lucette does not provide legal, financial, medical or other professional advice.

We may change or improve features. If a change materially reduces a paid service during your current billing period, we will give reasonable advance notice where practicable and you may cancel and request a refund for the affected unused portion. We may suspend or discontinue features when reasonably necessary for maintenance, security, legal compliance or service operation, with notice where reasonably practicable. Nothing in this paragraph limits your rights under the Australian Consumer Law.

Your content

You retain ownership of content you submit and any rights you have in generated output. You grant Lucette a worldwide, non-exclusive licence to host, process, reproduce and transmit your content only as reasonably necessary to provide, secure, support and improve the service and comply with law.

You confirm that you have all rights and permissions needed to submit your content and instruct us to process it. You are responsible for how you use, publish and distribute generated output.

Acceptable use

You must not use Lucette to:

  • Break the law, infringe rights or breach confidentiality obligations.
  • Create or distribute fraudulent, deceptive, abusive or harmful material.
  • Upload malicious code or interfere with the service or other users.
  • Attempt to bypass access controls, usage limits or security protections.
  • Access the service through unauthorised automated means or resell it without permission.
  • Submit personal or sensitive information you are not authorised to process.

Pricing, credits and subscriptions

Prices, currency, included credits and plan features are shown before purchase. Taxes may be added where required. Payments are processed by a third-party payment provider. You authorise the applicable charges when you complete checkout.

Purchased credits have no cash value, are not transferable and do not expire while your account remains available, unless a refund is required by law. Usage charges may vary with the work performed by a Template or other feature. The free offer is limited to the eligibility shown by the service and may not be combined across accounts.

A Pro subscription renews automatically at the interval and price shown at checkout until cancelled. Included monthly credits and any rollover treatment follow the plan displayed when you subscribe. We will give reasonable advance notice of a price increase or material reduction in plan benefits. You may cancel before that change takes effect.

Cancellation and refunds

You can cancel a Pro subscription through Manage Subscription in your account. Cancellation normally takes effect at the end of the current paid billing period. You will retain Pro access until then and will not be charged for the next period.

Except where required by law, subscription charges, used credits and completed credit purchases are non-refundable, and we do not provide partial refunds for an unused part of a billing period. If you believe a charge was made in error or the service did not meet a legal guarantee, promptly with the relevant transaction details.

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law. Where those guarantees apply, you may be entitled to a repair, replacement, refund, cancellation or other remedy depending on the circumstances.

Lucette intellectual property

Lucette and its software, branding, interface, templates and service materials are owned by us or our licensors. Except for the limited right to use the service under these terms, no rights in that intellectual property are transferred to you.

Third-party services and sources

Lucette may use or link to third-party services, websites and information sources. Their terms and privacy practices apply to their services. We do not control third-party content and are not responsible for its continued availability or accuracy.

Suspension and termination

You may stop using Lucette at any time and may request account deletion through account settings. We may restrict or terminate access if you materially breach these terms, create legal or security risk, fail to pay amounts due, or misuse the service. Where reasonable, we will provide notice and an opportunity to address the issue.

Disclaimers and liability

Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Subject to those rights, we do not guarantee uninterrupted operation or that generated output will be complete, accurate, current or suitable for a particular purpose.

To the extent permitted by law, Lucette is not liable for losses that were not reasonably foreseeable or caused by matters outside our reasonable control. Any limitation of liability applies only to the extent permitted by law and does not limit liability for fraud, wilful misconduct or a breach of a non-excludable consumer guarantee.

Changes to these terms

We may update these terms as Lucette changes. We will post updated terms here and give reasonable advance notice of materially adverse changes. Changes apply prospectively. If you do not agree, you may stop using Lucette or cancel your subscription before the changes take effect. If a materially adverse change affects a paid service during your current billing period, you may request a refund for the affected unused portion. Nothing in this paragraph limits your rights under the Australian Consumer Law.

Governing law and contact

These terms are governed by the laws of New South Wales, Australia, without limiting any mandatory rights you have under the law where you live. The courts of New South Wales and courts entitled to hear appeals from them have non-exclusive jurisdiction.
